Starting August 12, 2026, the EU’s new Packaging and Packaging Waste Regulation (PPWR, Regulation (EU) 2025/40) becomes directly applicable in all 27 member states. For e-commerce sellers who ship from China to customers in the EU—whether via Amazon FBA or your own Shopify/WooCommerce store—this means you must be prepared to demonstrate compliance with packaging rules, not just product safety or customs duties. This article walks through the essentials: who needs to register, what changes with PPWR, and how your consolidation and repacking operations in China can be aligned with your compliance obligations.

What is Changing: PPWR and Packaging EPR in 2026

PPWR is an EU-wide regulation that harmonises packaging rules and packaging waste management targets. It replaces the earlier Packaging and Packaging Waste Directive, but it works together with the existing national Extended Producer Responsibility (EPR) schemes for packaging. Under these schemes, companies that place packaged goods on the market in an EU country are responsible for the collection, sorting and recycling of that packaging. In practice, this means you need to be registered with the appropriate national register and, in most cases, join a producer responsibility organisation (PRO) that manages the recovery fees.

The key date is 12 August 2026: from that day, PPWR applies directly in all member states. Online marketplaces have an obligation to verify that their sellers comply with packaging EPR requirements. While national authorities were already enforcing EPR rules (for example, Germany’s LUCID register and the ban of non-registered sellers), the new regulation brings a more uniform approach across the EU. Sellers based outside the EU must appoint an authorised representative in each country where they sell.

Registration by Country: What You Need to Know

Each EU country has its own EPR register. If you sell in multiple markets, you may need to register in each one. Here are the most common ones for e-commerce sellers:

  • Germany: The LUCID register (maintained by the Central Agency Packaging Register – ZSVR). All sellers must register before placing packaging on the German market, and there is no minimum volume threshold. You also need to participate in a dual system for waste collection.
  • France: Registration with the producer responsibility organisations (such as Citeo for household packaging and IDU for industrial packaging). You must display the Triman logo and sort info on your packaging. Key accounts in France may also have obligations for extended producer responsibility in other categories like electronics or textiles.
  • Italy: The CONAI register (or its delegated body). Payment of the environmental contribution (PAC) is required.
  • Spain, the Netherlands, Poland and others also have mandatory registers.

For non-EU sellers, each member state requires you to appoint an authorised representative. Note that the exact procedures and deadlines may vary by country, so check the official website of the relevant national agency or your legal advisor. In practice, you should not rely on a single EU-wide registration – it is per country.

How Repacking and Consolidation in China Affects Your Packaging Compliance

Many sellers use a Chinese consolidation warehouse to combine multiple supplier shipments into one box before sending to Amazon FBA or the end customer. This 'repacking' is also subject to packaging requirements.

PPWR includes specific provisions on the empty-space ratio for transport packaging. That means the amount of empty volume inside the box must be limited, and filling materials such as bubble wrap, air pillows or paper shavings are considered part of the empty space. The exact limit is defined in the official text of Regulation (EU) 2025/40. What matters is that you, as the seller, are responsible for ensuring your transport packaging meets those rules.

Coordinating VAT, Customs and Packaging Obligations in 2026

Starting 1 July 2026, the EU also applies a new tariff on low-value goods imported from outside the EU (follow the official EU publication for accurate details). On top of that, the Import One-Stop Shop (IOSS) continues to handle VAT on distance sales. These are separate compliance lines:

  • Customs/import duties: charged at import, depending on the product value and origin.
  • VAT: collected at sale via IOSS or at import.
  • Packaging EPR: a regulatory obligation independent of duties or VAT, requiring registration and reporting of packaging materials.

You should evaluate the combined impact on your landed costs. However, since exact amounts depend on your product category, country of import and current rules, use the latest official guidance – do not rely on outdated fixed percentages.

Your Pre-August 12 Compliance Checklist

Here is a practical checklist to complete before 12 August 2026:

  1. Identify the EU countries where you sell (or intend to sell) and confirm whether you are considered a 'producer' under each national packaging law.
  2. For each country, check whether you already have a registration number (e.g., LUCID ID in Germany). If not, initiate registration now.
  3. If you are a non-EU seller, appoint an authorised representative in each country where required.
  4. Join the national PRO (duales System in Germany, Citeo in France, CONAI in Italy, etc.) and keep your packaging data up to date.
  5. Integrate packaging data collection into your supplier and warehouse SOPs – including item weight, material and size – so you can fulfil annual reporting duties.
  6. Review your repacking/consolidation process in China to ensure transport packaging meets PPWR space and material requirements.
